Himachal High Court Rules in Favour of Married Daughters for Compassionate Appointment, Quashes State Order

In a landmark judgment, the Himachal Pradesh High Court has ruled that a married daughter is also entitled to compassionate appointment after the death of a government employee. Justice Jyotsna Rewal Dua set aside two state government orders that had rejected petitioner Savita’s claim on the grounds that her family income exceeded the permissible limit.

The court observed that the state had calculated family income by considering only two members, ignoring the presence of the mother and three married daughters. It termed the government’s action arbitrary and discriminatory.

The High Court has directed the state government to reconsider Savita’s application for compassionate appointment within six weeks.

Savita’s father, who was a Junior Basic Trained (JBT) teacher in the education department, passed away while in service on April 6, 2012. She applied for a job on compassionate grounds in 2018, but her request was rejected on November 12, 2018, citing that there was no provision for married daughters.

The court also dismissed the government’s argument regarding delay in application, stating that the earlier policy did not consider married daughters eligible, hence the delay was justified.
