Supreme Court Orders: Home Guard Personnel to Receive Duty Allowance Equal to Police Constables

Historic Verdict: Home Guards and PRD Jawans to Receive Pay Equal to Police Constables

New Delhi, August 22, 2025: In a landmark ruling, the Supreme Court of India has reaffirmed the principle of "equal pay for equal work," granting Home Guards and PRD (Provincial Armed Constabulary) personnel the entitlement to duty allowances on par with those received by police constables.

  • The judgment reaffirms the legal precedent established in Home Guards Welfare Association vs. State of Himachal Pradesh, reported in (2015) 6 SCC 247.
    The duty allowance includes basic pay, grade pay, dearness allowance, and washing allowance.
  • The State of Himachal Pradesh had challenged the order via Diary No. 36000/2025, which the apex court has now dismissed.
  • Simultaneously, in Sanjay Kumar & Others vs. State of Uttar Pradesh & Others (SLP Diary No. 41057/2025), senior advocates Vinod Sharma (AOR) and Gaurav Kumar sought the extension of similar benefits to all 45,000 PRD personnel in the state.
  • The Supreme Court upheld the interim order of the Division Bench and granted the petitioners freedom to approach the Allahabad High Court to extend these benefits to all PRD jawans.

This landmark verdict upholds the constitutional values of equality (Article 14) and the right to life with dignity (Article 21), delivering long-overdue justice to thousands of frontline personnel.
