Himachal Pradesh High Court Takes Strict Stance on Post-Retirement Service Extensions and Re-employment

The Himachal Pradesh High Court has taken a firm stance on the issue of service extensions and re-employment granted to officials and employees after retirement. The court has directed Chief Secretary Sanjay Gupta to submit a detailed affidavit listing all service extensions granted from 2017 to date.

The case is linked to the violation of a significant December 19, 2017, judgment. At that time, the court had clearly ordered that no employee would receive a service extension after retirement unless they qualified under Chapter-22 of the Handbook on Personal Matters and Fundamental Rule 56(D).

The petitioner’s lawyer informed the court that, despite the clear orders, the government had granted service extensions to several retired officials and employees in violation of the rules. Justice Virendra Singh’s bench has instructed the government to present a full list of all extensions granted since December 19, 2017. The next hearing is scheduled for April 7.

The lawyer emphasized that service extensions should only be granted to employees with exceptional capability, intellectual and scientific merit, and outstanding contributions in their field. Such extensions should remain limited to rare cases.
